RE: The tariff classification of babies’ and girl’s cardigan tops from Macau

Dear Mr. Imbrogulio:

In your letter dated June 4, 1999 you requested a tariff classification ruling.

You have submitted two items that are both made from fine knit fabrics which you state are 100% polyester. These fabrics, which are fleeced on both sides, weigh between 330 and 335 grams per square meter.

The first sample is a long sleeve cardigan with a full front right over left opening that is secured by four plastic buttons. The round neckline and all other edges are hemmed. You have indicated that this garment will be imported as style BN5137 in sizes 9M to 24M and as style ON5137 in sizes 2T to 4T. The second sample is a hooded, long sleeve cardigan with a full front opening secured by a large plastic zipper. This garment has a patch pocket on the side of lower front. The pockets, as well as the hood are finished with a narrow band of contrasting color rib knit. The sleeves and bottom are hemmed. You have indicated that this garment will be imported as style NLG51003 in girls’ sizes 4 to 6X and as style NBG51003 in girls’ sizes 7/8 to 14/16.

The applicable subheading for Style BN5137 will be 6111.30.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for Babies’ garments and clothing accessories, knitted or crocheted: Of synthetic fibers: Sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, except those imported as parts of sets. The rate of duty will be 32.3 percent ad valorem.

The applicable subheading for Styles ON5137, NLG51003 and NBG51003 will be 6110.30.3055, HTS, which provides for Sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: Of man-made fibers: Other: Other: Other: Other: Women’s or girls’. The rate of duty will be 33.1 percent ad valorem.

Style BN5137 falls within textile category designation 239 and the other styles within category 639. Based upon international textile trade agreements, products of Macau in category 639 are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should be verified at the time of shipment.

In accordance with your request, your samples will be returned to you separately.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
